Lots of interesting stuff in that article. The court ignored the inverse-ratio rule, which has traditionally held that the more exposure the later writer has to an earlier work, the lower the bar for proving copyright infringement. Later in the article it notes that additional appeals courts, too, are now ignoring the rule, since in the age of ubiquitous streaming, it's almost impossible to prove or disprove how much exposure someone might have.

 

That wouldn't be a factor in this case though, so odd that they'd still ditch it. Particularly since Page & Co decidedly DID have exposure to the earlier song.

 

Also, I note how cheesy the judge's ruling is, using "stairway to heaven" to describe the case itself. Ick.

 

Anyway, IMHO Page & Co probably DID rip off that riff, since they ripped off everything else they heard, but it's also sufficiently different from the "Time in a Bottle" one in the Randy California song that the ruling is probably fair.

I already copyrighted a 12-bar blues song that has uses 4-5-1 instead of 5-4-1. So you don't get my 73 cents I made off that song

Dolly Parton's song "We Used To" from 1975 has a similar descending sequence. In 2002 she actually performed "Stairway".

I just listened to Taurus again and still do not hear any resemblance between it and Stairway. To me, it's just a descending arpeggio on an acoustic guitar. Big whoop. The notes don't align in my ears, no matter how many times I listen to it. Don't get me wrong, Taurus is a nice tune and I like it, but similar to the Stairway To Heaven intro? Nah... It takes more than "descending," "arpeggio," and "acoustic guitar" to make a match.

Yeah, I cannot really hear it either. In the end it was probably a fair result. My OP comment was actually about it's about time it was over, rather than Led Zep getting the win hahaha!

I thought an interesting aspect was that since the songs were written prior to 1976, the court was not allowed to hear audio clips for comparison, they had to go off sheet music.
