Do you have a good friend who is a lawyer, one who may be familiar with Mississippi law?

 

If so, please PM me. I'm trying to research something my Wife & I have been trying to take care of with the sale of our mobile home.

most every city has a bar association phone number in the phone book, and that org runs a referal service. It's kind of a 'don't hate us 'cause we're lawyers' thing. You call them, they'll refer you to a lawyer in your area who will listen to you and then give you some quick recomendations, no further obligation. I think that it costs about $25.

BiC, my day gig (more like real, paying gig) is the practice of law. However, I'm in Connecticut. I have made some connections with lawyers in other states through the American Bar Association. I'll check to see whom I've met in Miss and PM you with some names.

No apologies necessary. You see, that would be a fair question. However, if you'd noticed, in my original post, I didn't say anything about "friends". I did mention "connections". There is far less honor needed between mere connections.

As much as I enjoy all the lawyer jokes, out of respect for Vinny I will refrain from telling any of them on the forum. :cry:

This is why I'm asking, so you can pass it along to your connections.

 

My Wife & I are trying to sell our mobile home. But my Wife's ex-husband is still on the title.

 

She hasn't had contact with him since 1998. We have been trying to locate him for nearly 2 years. His family doesn't know where he is either. Of course, we can't just sign the title over without his sig. I hired a lawyer last November to get the title cleared, but it is "still in the courts". I personally believe my lawyer is incompetent and I'm about to fire them, as I did the first. Yes, this is our SECOND lawyer. Anyways, a partition suit was filed, and the interests have been divided, according to my lawyer.

 

Now, I am being told by my lawyer that there must be a "commissioner's sale of his interest" for the title to clear. We were not under the impression this had to be accomplished. We thought the partition suit would clear the title.

 

I further questioned my lawyer (through email) what the ex-husband's interests are, and the pro's and con's of a commissioner's sale. But I haven't heard back from her yet- 2 weeks and waiting. I've really given up on her, and want to proceed without her.

 

To some, it would be easy to fire their lawyer. But before I fire yet another lawyer, I need to know if there is anything else that can be done besides a commissioner's sale, just in case that is not in our best interest- costing us yet more $$$. If there isn't, then I will ride this one out while hot on her BUTT to get this taken care of!!!

 

I need to educate myself on my options before I proceed any further.

 

Now, I've heard of something called a "Quiet Title Action". Could this be applied in our case since we have exhausted all means to locate my Wife's ex-husband? What's that involve? How long would that take?

 

We are literally at our wit's end on this, and HOPE to clear the title and sell before we close on our new home. We are also in the process of hiring a Private Investigator to locate him.

I can't really comment about what appears to be Miss law. In Connecticut, we do have partition actions. Those actions do result in court ordered auctions. What would be good is if you could force the "commissioner's sale" and come up with enough to buy the ex's interest at that sale. I'm sure the court would hold that money in escrow until Mr. ex could be found, then freeing up the house to be sold by you. I know that in the real world, money like that isn't always easy to come by.

 

A "Quiet Title" action (as the term is applied in most jurisdictions) would not be appropriate in this case. You seek to quiet title when ownership of the real estate is unclear. For example, when two neighbors are in dispute over a boundary line, one claiming he owns some of his neighbor's land, a quiet title action is appropriate to determine what is the actual boundary line. In your case, it seems pretty clear that the ex does own an interest.

 

Have you checked her divorce decree to see if there was some provision for transfer in the decree?

You should have already received an email from me.

So, I won't worry about repeating myself here. :)

 

BTW, the mobile home was not in the divorce decree. It was a "rush job", with distance separating the two. My Wife simply didn't think of it at the time because of the emotional turmoil she was experiencing. She now regrets that, but her lawyer should have had her back!
