Kick-Drum Logo for Band. Advice

So I am in a band that has decided (not my creation) to name the band "Dammit Jim" after, oddly enough, me. I guess I scowl at folks when they screw up and they all scowl back and say "dammit jim" whenever I screw up (never right? :cool:)

 

So, we want to get a logo/picture for the kick drum. I come up with an idea. Another guy comes up with one. Which do you prefer? Assume printed on a drumhead or on a thin vinyl sheet cut to size and velcro'd on head.

The first one is obvious... frankly the second one is an amazingly bad choice of font + color on that background. :freak:

 

Might want to get someone with some graphics chops to do it for you, though... ;)

I like the first one - no question of the reference. With the second one, people may not make the connection, plus the diamond plate background just doesn't seem to fit as far as a theme.

Every band name is used all over the place. Ours is obvious. There's a "that 80s band" in almost every major US city and 2 in Australia. I think the one in Detroit actually has it trademarked, so we can't play there.

No, we plan to toil in obscurity indefinitely. And I'm not kidding.

I know about the Oregon Band. More southern rock then us and considering we won't travel from our little berg (all married, kids, jobs) they won't crowd.

Not true at all, but at the same time it doesn't hurt to mention it, just in case they're in geographic proximity to one another (not sure if "in Chico" means in Chicago, or Chico, CA, in which case the Oregon thing isn't far off the mark. :P

Chico, CA is correct.

 

Eugene is still 400 miles away and at 7 hours drivetime, the other Dammit Jim is a small threat. If they were gonna travel that far, they would most likely hit the SF Bay Area for a bigger draw then a small college town, if they even travel out of the Portland area.

Yeah, lord knows a band trying to build a following would probably avoid college towns at all costs... :laugh:

Why would you knowingly use someone else's name and likeness for commercial use? It's not just an intellectual property rights issue (which it is). Leaving aside the rights to the Leonard McCoy image, particularly with the band name, do you want to:

 

- get sued (by mistake, of course, but it's still a hassle) when they get in a car wreck on the way to their first California gig? Or run up bills that they can't pay for?

 

- lose gigs because somebody recognized the name and remembered that their cousin had said the band (the other one with the same name, of course) is terrible?

 

Even in a world with a billion bands, it is possible to come up with a name and graphics that somebody else doesn't already own.

I started a band called "The Banthas" with star wars-ish font on the website. Lucas entertainment contacted me, so i simply shut down the website. The band fell apart anyways.

 

But dammit jim shouldnt have any issue like that.

When we played our 5 yr anniversary gig a couple years ago, we brought in the original band members. After several songs, the first guy who left the band exited stage as I played a video on the screens we set up...more on that later. The guy who replaced him came on, and after a few songs, the next guy left, video, etc, until the bands current lineup was left playing. Now for the video. I did a parody of MTV news from the 80s with Kurt Loader and the intro sound effects, etc. I did a VoiceOver with a fake story about some scandal that led to the band member having to leave the band - complete with discriminating doctored photos, etc. The guys didn't see the videos until the show when they left the stage and watched. It was quite hilarious.

 

Anyway, they wanted to see them after the gig so I posted them on YouTube. Well guess what, MTV didn't like it a whole lot, so yank. I guess if I had used a Kurt Loader look alike and rewrote my own intro music and sound effects that was just similar, it would have been ok.

btw... i like the name.... but it would be cooler if you didnt use any star trek likeness. The name is original.

I think the thrust of the thread is that the name isn't original. The thread already identifies an Oregon band with the same name, and a quick Google identifies a third Colorado band with the same name.

Edit: Just found two more; one in Tempe, Arizona and one in Long Island, New York. Dammit Jim, they're everywhere!

Just don't name it after the gym teacher. Been done.

 

I always google-check a band name first.

 

But even more important is whether it's still available on facebook. For a startup act getting gigs on the pro-am circuit, a FB page seems to be the first critera. Having good players, great material, a big following, etc, hardly matters in comparison.

 

This may not apply to more professional acts where the members have street creds already at the venues they plan to play.

My old band was based in Eugene, and we played Chico a couple of times a year. We'd do a circuit of the college towns on our way down to the Bay Area, Ashland, Chico, Davis, sometimes Sacramento. Plus, we'd get bands from Chico and Davis coming through all the time. So the odds of you crossing paths with the other D-Jim are not that slim.

 

On the other hand, I've never heard of the Eugene band, so they may not be too serious of a threat. Not that I pay attention to everything that happens around here, but if they were a major draw or were touring, I'd probably at least know the name.
