I was wondering If it would be better to go to a publishing company and give 50% of the publishers share or start your own publishing company doing the leg work but keeping the 50%?

Good question and the answer depends on your contacts in the biz.The job of a publisher is really to get your stuff placed (assuming you are writing with the goal of having others redord your music or having it used in TV, film, etc.). For doing that work, they take a cut. Yes, you can keep that cut yourself, but can you get your music placed where it can make you some money? Keep in mind that 100% of nothing is, well, nothing...

According to a book I read called "Music Law" by Richard Stim what your suposed to do is both. In order to get the full amount of your royalties apperantly bands have to have their own publishing company and be signed to a publishing company as well. This will alow the band to get 50 percent of money for performance from radio, record sales, movie and TV rolaties which ASCAP or BMI will aquire. The publishing company your band signs to will get the other 50 percent because they own the copyrights, but then they split that with a publishing company your band starts so that each publishing company gets 25 percent. From what I have read, it is done this way because publishing companies aren't involved with the production of music like they were back when bands didn't write there own material but music was written by writters hired by the publishing company and paid by the hour like. Today, most bands write their own material and just need a publishing company to help get it out there, because of this publishing companies don't deserve what they used to deserve. So this system was devised to get bands the money that back in the day would have been paid to the writters of the music. I hope that makes sense and helps, I'm in a band and my question that I can't figure out is HOW do you go about starting your own publishing company?

100% of nothing is nothing. Sometimes it's better to go with a professional company.

I have a related question. I worked with a man who claimed to be a publisher/producer
and he recorded my copyrighted songs at a studio, the ending process was a couple of hand out CDs of four of my originals and a
fax from him stating he owns the Mechanics
of the songs and he will try to showcase me and this material. hich he did accordingly.
It's been 2 years since and just to include, in the fax letter he sent me, it states that if I am still workign with him on this deal then he assumes all rights as stated here above that I have mentioned. Since I have put my material on MP3.com and felt the need to make this publisher/producer aware of the sales I am making of his recordings. My question is what is fair percentage? AM I obligated to give him any monies? I thought that if a publisher was unsuccessful in making a demo plan work than I am released?
