He should not have to serve jail time, and live off the public for free. Instead, he should be sentenced to several thousand (or million) hours of community service, scrubbing the spam and viruses off of everyone's computers. (Or use the fines to buy everyone a Macafee upgrade).

it is high time that business was responsible for their part.
no more washing their hands by getting someone to do the dirty work.

Yeah, you're definitely right there.
I mean, there's existing examples of crimes where both the buyer and the seller are prosecutable (receiving stolen goods, arms trafficking, people trafficking, drug dealing), so why not spamming? It'd make sense.
