Dr Al...
So a band records a cover of a song after getting a license from the publisher. I then want to license that sound recording to put on a compilation CD. Do I have to worry about dealing with the song publisher, or does the band's license typically cover this?

if it;s the same exact recording you licensed you dont have to do it again. You do, however, have to send them their share of sales royalties.

The band or the publisher? If it's the publisher, then I assume that the owner of the recording will have to provide me with their exact deal if it wasn't for the statutory rate?
Also, how doesn't it get complicated if it's a portion of a song used for a promo. Say we're going to use :30 secs of the exact same recording. The owners let's us use the recording for free. Would the publisher be entitled to the full amount? Something less? Is this a new negotiation?
Sorry for all the questions, but I'd like to get clear on this in my own mind. Besides I'm tired of the Napster debate.

if you record the song "X" and you get a license from the publisher, if that song is used on a compilation, then you dont beed to license it again from the publisher - you just need to send them whatever royalties accrue. The license id for a PARTICULAR RECORDING OF A SONG. If the song is used in a promo, I have no idea. If it's a paid advertisement, then BMI or ASCAP will log it and whoever airs it has to pay them and they pay the publisher, i imagine.

Go to the Harry Fox Agency web site and apply for a Mechanical Reproduction License for the song you wish to cover. This license enables you to do the cover version of the tune and sell up to 500 copies. You pay $37.75 upfront ( on line if you wish ) for the license to do so. This is provided the song is 5 minutes or less. If you sell more, then it translates to an additional 7.55 cents a copy. I did a cover of the Beatles {{{ Magical Mystery Tour }}} and that was the procedure I needed to go through..
