Agreed. We mostly differ in how we define melody, as I was taught in music history and music theory classes at conservatory, that the key defining characteristic of a melody is the beat and then the rhythmic motifs.

 

But I understand what you're saying about African music in particular -- although I might argue that there is harmonic intermodulation going on. :-)

If you think about it, zep was entering the height of their success when they recorded stairway. It would have been mighty sleezy of page to rip off another artist while he was at his peak success. Just strictly speaking of character.

If you just read the lyrics for both songs, why is the Zep version not a copyright violation just based on the lyrics? Put them up side by side.

 

It actually was.

 

The Small Faces tune was actually a cover of a track done by Muddy Waters:

 

Willie Dixon wrote the lyrics for Muddy, who sang them over an instrumental track already recorded by Earl Hooker.

 

In 1985 Zep was sued for "nicking" the lyrics written by Willie. Out of court settlement in Willie's favor, which is why Willie Dixon is now credited as a co-writer on the Zeppelin tune - which is essentially a cover I suppose after hearing these previous versions.
