Has anyone noticed that ESPN's Monday Night Countdown theme song is almost a direct rip-off of The James Gang's "Funk 49"? Same guitar groove, chords, sound, and even the iconic Joe Walsh single note stuttering descending line into the riff...

FUNK 49

I am continually amazed how low some musicians go when ripping off other people's music. I am sure it was not acknowledged because "just enough" of the song is different... But it is obvious to most musicians who know the music.

Why do musicians do this? Lack of creativity? Are they truly "Hacks"?

They do it because somebody from ESPN comes up to them and says "Hey, we want something that sounds as close to Funk 49 as you can but won't get us sued." And usually they get away with it although sometimes it bites them in the ass.

I'm pretty sure I've heard Boomer (Chris Berman) thank Joe Walsh for the song. I think it is him.

Really? Then why not just play "Funk 49"? That would be interesting if indeed it is him...

As far as your question in general, what B3-er said. It's pretty common for clients to ask for that. I remember articles in Keyboard about it, where the artist comes back with a song that's different and in the same vein, and the client pushes to get closer to the song being copied. Smart artists assign all liabilities to the client. smile

It has to do with licensing/publishing. You'll hear that a lot in commercials. The background music will sound almost like a well-known song, but just a little different. Or, they'll pay someone to re-record the song (a cover, basically), because it's less expensive than using the original recording.

Specifically, they're only paying the publishing half, and not the mechanicals, because it's a work for hire for the session guys that come in and do the "cover" version.

Sticking with the sports theme, I'm pretty sure I recall hearing something about how ABC's Wide World of Sports copped parts of ELP's "Fanfare" for the musical segment that opened each show, back in the 1970s. Some of Carl's drum parts were especially blatant, IIRC.

My personal preference was Funk #37 by his brother Keith Walsh with the Hammond parts.

Funk #12 by his second cousin Joe Monroe is so fast it sounds like bluegrass.

And I know everybody likes Funk #158.93875 for the Bela Fleck banjo break but it just ain't my thing.

We could go on forever arguing about Funk #s. D*mn that Joe Walsh crazy
